A resolution providing for the control of dogs and cats within Riley County, Kansas, outside the corporate limits of any city

BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF RILEY COUNTY KANSAS: Section 1: Keeping and Harboring of Dogs Defined

Any person who shall allow any dog, except feral dogs, to habitually remain or to lodge or be fed within his or her home, store, yard, inn, enclosure or place located outside the corporate limits of any city, within Riley County, Kansas, shall be deemed and considered as keeping and harboring such a dog within the meaning of the Resolution.

Section 2: Keeping and Harboring of Cats Defined

There is no definition at this time.

Section 3: Nuisances

1. Molests or interferes with persons in the public right of way or chases vehicles; 2. Attacks or injures persons, or any domestic animal; 3. Damages public or private property other than that of its owner or harborer by its activities or with its excrement; 4. Scatters refuse that is bagged or otherwise contained; 5. Causes any condition which threatens or endangers the health or well-being of persons or other animals; 6. Causes a disturbance by loud, frequent and habitual barking, howling, yelping, mewing or screeching.

There shall be a rebuttable presumption that a nuisance is created if any person keeps or harbors more than five dogs, over the age of 90 days, upon any premises within Riley County, Kansas, and outside the corporate limits of any city, unless such premises are licensed as a kennel by Riley County.
